Terms of Service

What you're agreeing to when you use SeaMate — written plainly, because you deserve to know.

Nobody actually enjoys reading one of these, and we won't pretend this one's a thrill either — but boating has real risks, and there are some important things here we need you to genuinely understand, not just scroll past. We've kept it as plain and honest as a document like this can be. Here's what you're agreeing to:

In any emergency at sea, use your VHF radio on Channel 16 and activate your EPIRB/PLB first. Use this app as a secondary aid only.

1. Agreement to Terms

By downloading, installing, or using SeaMate ("the App"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. RisleeTree Studios ("we," "us," "our") reserves the right to update these Terms at any time. For material changes — including changes to Assumption of Risk, Limitation of Liability, Arbitration, or the Class Action Waiver — you will be required to explicitly re-accept the updated Terms before continuing to use the App. For non-material changes, continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age to create an account or purchase a subscription for the App. If you are under 18, you may use the App only under the direct supervision of, and with the consent of, a parent or legal guardian who has read and agreed to these Terms on your behalf and who accepts full responsibility for your use of the App. The App is not directed at children under 13, and we do not knowingly collect personal information from children under 13.

3. Nature of the App — Informational Use Only

SeaMate provides navigational reference information including but not limited to tide data, weather summaries, chart displays, vessel tracking, anchor watch, bridge clearance calculations, distress communication templates, and AI-generated passage guidance. All information is provided FOR REFERENCE AND EDUCATIONAL PURPOSES ONLY. Nothing in this App constitutes professional maritime, navigational, meteorological, medical, or legal advice.

4. Data Accuracy — No Warranty of Correctness

The App displays data from third-party sources including NOAA, the National Weather Service, OpenWeatherMap, and AIS providers. We make no representation that any data displayed is accurate, current, or complete.

Emergency contact information for USCG Sectors, USCG Stations, and Coast Guard Air Stations displayed in this App is sourced from publicly available records and manually verified. This data may become outdated. ALWAYS verify emergency contact numbers through official USCG channels (uscg.mil) before relying on them in an emergency.

AI-generated content (conditions briefings, passage plans) is produced by a large language model and may contain errors. Do not make safety-critical decisions based solely on AI-generated content.

This App displays the Navigation Disclaimer required under Apple's Developer Program License Agreement §3.3.3(F)(iii) — see the boxed disclaimer above.

5. Offline Mode & Data Storage

To support use in areas without cellular or internet connectivity, the App lets you download charts, tides, currents, and other data for offline use. This offline data begins to degrade the moment your device disconnects from the internet and can become dangerously outdated over time. Offline data does not automatically receive updates such as Notices to Mariners, chart corrections, revised tide predictions, or new hazard information while your device remains offline.

You are solely responsible for connecting to a stable internet connection and fully refreshing all downloaded data immediately before each use of the App for navigation. Do not assume that data downloaded on a previous occasion remains current, complete, or safe to rely on.

We are not liable for chart corruption, incomplete or interrupted downloads, or the loss of downloaded data caused by insufficient device storage, operating system memory management (which may automatically delete cached data to free space), device failure, or app reinstallation.

6. Assumption of Risk

Boating, navigation, and any activity on or near open water involve inherent and significant risks, including but not limited to: severe weather, mechanical or equipment failure, collision, grounding, capsizing, flooding, fire, falling overboard, drowning, hypothermia, severe injury, and death, as well as financial and property risk including loss of or damage to your vessel, equipment, or cargo, and the costs of repair, salvage, towing, or replacement. These risks exist regardless of whether you use the App and are not created, caused, or increased by the App.

By using the App, you acknowledge that you understand these physical and financial risks and that you knowingly and voluntarily assume all such risks, whether or not related to your use of the App. You further acknowledge and assume all risk arising from your reliance on any information, chart data, weather data, tide or current predictions, routing suggestions, AI-generated content, or emergency contact information provided by the App, including risk arising from any inaccuracy, delay, or failure of the App to function as expected.

This assumption of risk applies to the fullest extent permitted by applicable law and is independent of, and in addition to, the limitation of liability and disclaimers set forth elsewhere in these Terms.

7. Limitation of Liability

To the maximum extent permitted by applicable law, RisleeTree Studios, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

For any claim relating to loss of or damage to property, including your vessel, equipment, or cargo, or to any commercial loss, our total liability to you for all such claims shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater.

For any claim relating to personal injury or death, our liability is limited to the maximum extent permitted by applicable law, rather than to the fixed dollar amount above. The property/commercial damages cap in the preceding paragraph is a separate and independent limitation from this personal injury limitation; if a court declines to enforce one, the other shall remain in full force and effect.

8. No Warranty

The App is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or reliability of any information obtained through the App.

The distress features in this App (including MAYDAY templates, USCG contact information, and SMS functions) are provided as convenience tools to assist users in preparing emergency communications. We do not guarantee that:

11. MOB (Man Overboard) Feature

The Man Overboard feature marks a GPS position and provides bearing and distance information. This feature depends on device GPS accuracy, which may vary. GPS signal may be degraded or unavailable in some conditions. Do not rely solely on this feature during a MOB emergency. Assign a dedicated crew member to maintain visual contact with the person in the water.

12. Automated Alerts & Calculations — Anchor Watch, Bridge Clearance, and Similar Features

Anchor watch, bridge clearance calculations, and other automated alerts in this App depend on continuous, accurate GPS data and device power. Mobile operating systems (iOS and Android) may suspend, throttle, or delay background location updates to conserve battery — especially in low-power mode, when the App is backgrounded, or when connectivity is poor — and the App has no ability to override this behavior. GPS accuracy itself can also degrade or fail entirely in some conditions.

Bridge clearance calculations are based on charted clearance data and do not account for real-time tide height, vessel-specific loading, antenna or rigging height beyond what you enter, or other factors affecting actual overhead clearance at the moment of transit.

You must never rely on this App, including its anchor watch or bridge clearance features, as your sole means of preventing a grounding, bridge strike, anchor drag, or collision. Maintain an active anchor watch by traditional means (visual bearings, radar, or a crew member on watch) and independently verify bridge clearance against current tide data and your vessel's actual air draft before transit.

SeaMate uses Anthropic's Claude AI to generate conditions briefings and passage planning suggestions. You acknowledge that:

14. Third-Party Beneficiaries

The App displays or incorporates data and content from third-party providers, including but not limited to NOAA, the National Weather Service, OpenWeatherMap, AIS data providers, and Anthropic (which provides the underlying AI model for AI-generated content). Each such third-party provider is an intended third-party beneficiary of the disclaimers, limitations of liability, and releases set forth in these Terms, and each may enforce those provisions directly against you as if it were a party to this agreement.

15. User-Generated Content & Data

You retain ownership of content you create for your own personal use through the App, including logbook entries, notes, and photos attached to your voyage log. This content is stored on your device and is not transmitted to us except as necessary to provide App functionality.

Some features may let you voluntarily submit information for shared or crowdsourced use — for example, reporting a hazard, correcting marina information, or contributing depth or condition observations visible to other Users ("Contributed Data"). By submitting Contributed Data, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, store, reproduce, modify, aggregate, display, and distribute that Contributed Data, including to other Users, without compensation to you.

You represent that any Contributed Data you submit is accurate to the best of your knowledge at the time of submission. We do not guarantee the accuracy of Contributed Data from any User and are not liable for decisions made in reliance on it. We may edit, remove, or decline to publish Contributed Data at our discretion, including data we believe to be inaccurate, abusive, or unsafe.

16. Subscriptions & Auto-Renewal

Certain features of the App require a paid subscription, purchased and billed entirely through your Apple ID via the App Store. Current subscription lengths, prices, and any free trial offer are displayed on the purchase screen within the App before you are charged, and those terms — not any price stated elsewhere — govern your purchase.

Subscriptions automatically renew for the same length and at the then-current price unless canceled at least 24 hours before the end of the current billing period. Your payment method will be charged for renewal within 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your device's Settings → [Your Name] → Subscriptions.

Except as required by applicable law or the App Store's own refund policies, payments are non-refundable and we do not provide refunds or credits for partial subscription periods.

17. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms, misuse the App, or engage in conduct we reasonably believe is harmful to us, other Users, or third parties. You may stop using the App at any time; canceling a paid subscription is done through your Apple ID as described in Section 16 and does not, by itself, terminate these Terms.

Sections of these Terms that by their nature should survive termination — including but not limited to Assumption of Risk, Limitation of Liability, Indemnification, Third-Party Beneficiaries, and Governing Law & Disputes — shall survive.

18. Indemnification

You agree to indemnify, defend, and hold harmless RisleeTree Studios, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of or reliance on the App, including without limitation any third-party claim — such as a claim by the owner or operator of another vessel — alleging injury, death, or property damage arising from your operation of a vessel or your use of the App.

19. Governing Law & Disputes

To the extent your claim arises from or relates to activity on navigable waters, these Terms and any dispute arising from them shall be governed by the General Maritime Law of the United States. To the extent General Maritime Law does not apply or does not resolve an issue, these Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, conducted in New Jersey unless the AAA's rules provide otherwise for your circumstances, except that either party may seek injunctive relief in any court of competent jurisdiction.

20. Class Action Waiver

You and RisleeTree Studios agree that any claim shall be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, whether in arbitration or in court. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, collective, or representative proceeding.

If this Class Action Waiver is found unenforceable as to a particular claim or request for relief, that claim or request must be severed from arbitration and may be brought in court, but the remainder of this arbitration provision shall be enforced.

21. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
